Buyer Agreements: Each Buyer Agreement must be understood and initialed.

 

Buyer agrees that s/he is not acting as an agent in the purchase of this kitten; and, that the kitten will reside at the home of the Buyer. Buyer agrees to responsible ownership and to keep the kitten clean, healthy, free of undue stress and harassment, and well nourished. Fresh water will be available at all times. Kind and humane attention will be given. The cat will be provided with prompt medical care when necessary. 

 

The cat will not be declawed. If declawed, health guarantee will be void.

 

Non-clay litter will be provided for the kitten at least until age 12 month, but preferably throughout the cat’s lifetime.

 

Buyer will provide a sanitary, indoor environment with sufficient room and space, without unnecessary confinement.   Under no circumstances will the Buyer permit this kitten to roam freely outdoors.

 

Buyer will follow protocols for introduction of other pets to kitten. Buyer understands that an initial confinement with slow introduction to resident animals is a protection for all animals.

 

This kitten is sold intact with a commitment to alter. Registration papers will be provided to the Buyer after veterinary proof of altering is provided to the Breeder. The kitten will be altered by 8 months of age, or at an age agreed upon with Breeder. The cat is not to be bred at any time. If any kitten is found to be unaltered after 8 months of age, s/he may be taken back by the Breeder at Buyers expense.

 

Breeder recommends minimal vaccinations for an animal kept indoors in a healthy environment. Immunization records and recommendations will be provided at the time of sale. The FIP vaccine should not be given. If the Buyer uses this vaccine, the Breeder will not replace the kitten/cat should it subsequently develop FIP.  An indoor only cat does not need the Feline Leukemia vaccination. If the FeLV immunization is given to your kitten, it will void the health guarantee.  

 

The Buyer is contracted to provide a lifetime home for the kitten. If the Buyer is unable to keep the animal, the Breeder will be contacted. The kitten will not be sold to another individual without the expressed permission of the Breeder, or sold or given to an animal shelter, humane society, pet store, research lab, or be abandoned. Any animal taken back by the Breeder because of negligence or improper care will not be subject to any refund policy.

 

The Buyer may return the kitten to the Breeder for any reason within 72 hours with 50% refund, less deposit. Buyer will pay for all the transportation costs incurred for the return. The Breeder will not be liable for any costs incurred by the Buyer during the 72 hours. After 72 hours have elapsed, Buyer assumes all responsibility of ownership of this kitten, including, but not limited to veterinarian costs. All sales are final after 72 hours. Breeder will always take a SpiritHill kitten/cat back for any reason, at any time, but no refund or replacement is implied. Refund or replacement is at the Breeders discretion. There must be a satisfactory reason for any refund.

 

 

Breeder Agreements:

 

  • This kitten, to the best of Breeder’s knowledge, is healthy at the time of this sale, and is progeny of animals that are healthy. A Health Certificate will be provided. This health guarantee includes bacterial, viral, and fungal infections, and internal and external parasites. This guarantee extends for 3 days from the time the kitten goes to his new home. If during the 3 day guarantee period the kitten appears ill, it is to be examined by a veterinarian. If the veterinarian feels that the kitten is ill with an illness that was present prior to sale, the Breeder should be contacted immediately, before any major treatment is initiated (except in an emergency situation). The Breeder will pay for the cost of the treatment up to the purchase price of the kitten, after receiving the veterinary statement verifying that the illness was present prior to the sale. The Breeder must be included in the treatment plans and be given access to veterinary records. In the case of a dispute, the Breeder reserves the right to take the kitten to a veterinarian of the Breeder’s choice for a second opinion, at the Breeder’s cost. The second opinion will be the deciding diagnosis.

 

  • The Breeder has lovingly raised this kitten ensuring good health, proper socialization, and good temperament, in a free-roam home environment free of cages, constraints, smoke, or any cruelty. Kitten/Cat will be groomed, well-adjusted, happy and healthy at time of purchase.

 

  • This kitten has nursed until it has been weaned by the dam.

 

  • If purchased as a PET this kitten is guaranteed for the first 3 years against a GENETIC problem so severe that it prevents the animal from living a normal life as a pet, i.e. HCM, Severe Hip Dysplasia. Upon receiving written proof of a diagnoses of severe HD by an OFA or Penn Hip certification, or diagnosis of HCM by a certified Veterinary Cardiologist, the Buyer will receive a replacement with another kitten of equal quality as soon as available. Buyer may keep the original cat. Breeder is not responsible for any vet bills incurred. Buyer must provide a death certificate issued by a veterinarian in the event of a death in order to qualify for a replacement kitten. While every effort is made to place a healthy kitten, the breeder cannot guarantee against FIP, or herpes.  If a kitten dies from FIP within one year of age, a replacement kitten will be offered, but no cash refunds will be rewarded. A written necropsy report will be required.

 

  • Breeder will provide information and recommendations to the Buyer concerning nutritional requirements/food and the introduction of a kitten/cat into a new home.

 

  • Breeder will be will be available to you for the lifetime of your kitten(s)/cat(s) to answer questions, give pointers and be a support to you.

 

  • The most common heart problem in felines is HCM or hypertrophic cardiomyopathy.  Ancestors of this kitten have tested negative/negative for one of the genes that has been discovered to cause HCM (MyBPC); therefore the kitten is negative. This test does not guarantee a cat will not develop HCM, but should not develop the type caused by this mutation., which has been estimated to cause 65% of HCM in Maine Coons.  Results will be provided to you by request.

 

  • Cattery is FIV and FeLV negative, as is this kitten.
     

This Contract Is Made and Signed by Both Parties to Ensure the Well-being and Protection of this Kitten. This Contract Constitutes the Full Agreement Between Buyer and Seller. No Other Warranty, Verbal or Written, Is Implied.

 

If the Buyer is found to be in violation of any of these terms and conditions, the Breeder retains the right to bring action against the Buyer in the State of Colorado for breach of contract and demand immediate return of the animal to the Breeder.

 

Additions and/or amendments to this contract must be initialed by both the Buyer and the Breeder/Seller.
